Compliance Requirements

Construction sites in the State of California greater than 1 acre in size need to expect that they will have discharges of stormwater during rain events. In order to comply with the Clean Water Act, regulations have been established regarding the management of these construction sites. To start with the landowner must obtain proper approval from the State Water Board. The submission process is done through the SMART system found on the State Water Board’s website. The required documents are as follows:

1. Notice of Intent
2. Detailed Site Maps
3. SWPPP - Stormwater Pollution Prevention Plan
4. Risk Assessment

Once approval has been granted, the activities of the construction site must adhere with the standards listed below. The intent of theses requirements are to keep pollutants out of the stormwater systems. A more detailed list of these requirements are found in Attachment C, Attachment D, and Attachment E of the General Permit.

Good Site Management for Construction Materials
1. Conduct an inventory of products used and/or expected to be used and the end porducts that are produced and/or expected to be produced.
2. Cover and berm loose stockpiled construction materials not actively being used.
3. Store Chemicals in watertight containers or a storage shed.
4. Implement BMPs to prevent the off site tracking of loose construction and landscape materials.

Good Site Management for Waste Management
1. Prevent the disposal of rinse or wash waters into the storm drain system.
2. Ensure the containment of sanitation facilities (ie. portable toilets) and inspect regularly.
3. Cover waste disposal containers every evening and during rain events.
4. Implement procedures to address hazardous and non-hazardous spills.
5. Include a spill response section in the SWPPP.
6. Ensure containment of concrete washout areas.

Good Site Management for Vehicle Storage and Maintenance
1. Prevent oil, grease, and fuel leaks into the ground.
2. Use BMPs for fueling and vehicle maintenance areas.
3. Properly and promptly clean leaks.

Good Site Management for Landscape Materials
1. Contain stockpiled material and fertilizers when not actively being used.
2. Stack erodible landscape material on pallets and cover them when not being used.
3. Discontinue the application of erodible materials within two days before forecasted rain events.

Good Site Management for other Potential Pollutant Sources
Assess and create a list of potential pollutant source including air depositon and identify additional BMPs. This list shall be kept with the SWPPP.

Non-Storm Water Management
Cleans streets and wash vehicles in a manner to prevent discharges to drainage systems and surface water.

Erosion Controls
1. Provide cover for inactive areas such as finished slopes, open space, utility backfill and completed lots.
2. Limit the use of plastic when more sustainable, environmentally friendly alternatives exist.

Sediment Controls
1. Maintain effective perimeter controls to stabalize all construction entrances.
2. Design sediment basins in accordance with CASQA’s BMP Guidance Handbook.

Risk Level 2 and Risk Level 3 Sites have these Additional Sediment Control Requirements
3. Implement appropriate erosion control BMP for areas under active constructon.
4. Apply linear sediment controls along the toe of the slope, face of the slope, and at grade breaks of exposed slopes to comply with shoot flow lenghts in accordance to the table below:

5. Ensure that all access to the construction activity is limited to proper construction site entrances
6. Ensure all storm drain inlets, perimeter controls, runoff control BMBs and pollutant controls and entrances are protected from activities that reduce their effectiveness
7. Inspect on a daily basis all immediate access roads. Prior to any rain event, remove any sediment or other construction related materials that are deposited on the roads.

Run-on and Runoff Controls
Direct run-on from off site away from disturbed areas.

Inspection, Maintenance and Repair
1. Ensure all inspection, maintenance, and repairs are performed by a Qualified SWPPP Practitioner(QSP).
2. Conduct weekly inspections.
3. Complete daily inspections during extended rain events and record BMPs that need maintenance.
4. Repair BMPs within 72 hours of identification.
5. Ensure checklists remain onsite with the SWPPP.

Construction Site Monitoring Program
The SWPPP shall contain a Construction Site Monitoring Program (CSMP). The requirements of the monitoring programs vary for each of the three risk levels. The CSMP emcompasses actions during rain events, quarterly or other inspections of non-stormwater discharge events, and rain event action plans.

Records
All records of inspections shall be kept on site during the construction and be maintained for three years. An annual report is due to the State Water Board no later than September 1 of each year with a detailed listing of all of the inspections.
